Part 1: Assess Client's Situation in an Estate Planning Context

The following case example effectively sets the stage for the subsequent detailed discussions during the main conference. Our fictional person's asset mix, risk tolerance and estate planning needs successfully touch upon the three main aspects of the process (and the conference): planning, investments, and insurance. You will leave this workshop with a clear view of how this solution makes sense from an estate planning, investment allocation, and wealth transfer/protection perspective.
Sally, a married mother of 5 children, is an entrepreneur with a $20 million net worth and a significant allocation to hedge funds in her portfolio. She decides to sell her very successful chain of beauty salons in Beverly Hills for $30 million, making her net worth suddenly $50 million. That's a substantial amount of wealth to preserve, grow, protect and donate to charitable organizations. Sally has many options to achieve these lofty goals, but our seasoned panel of market experts will show the advantages of a private placement transaction in the context of:
- Discuss various other options including family limited partnerships, sprendthrift trusts and asset protection structures
- Analyze Sally's risk profile through discussion of portfolio's allocation to various asset classes, including alternative classes
- Put the overall estate plan into perspective through gathering a team of advisers to align the client's charitable objectives with her current portfolio

- Conduct a proper carrier review to determine which carriers can adequately meet the client's needs. Key considerations include:
- Pricing components - Representations of guarantee considerations
- Role and importance of reinsurance including capacity limitations and claims paying liability
- Analyze the merits of using a $20 million commitment to a non MEC, including the ability to access the policy cash and death benefit payments tax-free
- Prepare the client for the underwriting process
- Discussion of applicable fees and how to manage client's expectations
- Address the client's concerns, including the degree of control she will have over the investment side of the transaction
- Choose the proper investment through understanding IDFs, why they're needed, investor control considerations, hedge funds vs. funds of funds, volatility considerations and risk and return tradeoffs
